Plain-English summary
Use Gizmo to track web analytics for sites you own or are authorized to track. Pay your bill or stay on the free tier. Don't abuse the service or do illegal things with it. We can change pricing or terminate accounts that break these rules. We're not liable for indirect damages. Disputes go to arbitration in Pennsylvania, US.

1. Acceptance
By creating an account or using Gizmo Analytics (the "Service"), you agree to these Terms of Service ("Terms"). If you're using Gizmo on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to that organization throughout.
The Service is provided by Gizmo Analytics, LLC ("Gizmo", "we", "us").
2. The Service
Gizmo provides web analytics: a tracking script you add to websites you control, server APIs to query the resulting data, an MCP server for AI-assistant access, and a dashboard at gizmoanalytics.io.
We add features and improve the product over time. We may modify, suspend, or remove features with reasonable notice for material changes.
3. Accounts
You sign in with Google OAuth or via email magic link. You are responsible for keeping your account credentials secure. You are responsible for all activity that occurs under your account, including activity by anyone you share API keys with.
Notify us immediately if you believe an unauthorized party has accessed your account. We'll help you secure it.
4. Acceptable use
By using Gizmo, you agree NOT to:
- Track sites you don't own or aren't authorized to track
- Send fake or fabricated event data designed to mislead anyone
- Attempt to access other customers' data
- Reverse-engineer, scrape, or attempt to circumvent rate limits or quotas
- Use the Service to track personally identifiable information beyond what the tracker is designed to capture (no PII in custom event properties)
- Use the Service for any illegal purpose, or to track activity that violates any law in your jurisdiction or ours
- Resell access to the Service without our written agreement
We may suspend or terminate accounts that violate these rules. For severe or repeat violations we may do so without warning.
5. Plans and billing
Gizmo offers a free tier and paid plans. Paid plans auto-renew at the end of each billing period (monthly or yearly). You can change or cancel your plan at any time via the Stripe Customer Portal accessible from your dashboard.
Trials:paid plans include a 30-day free trial. We do not require a credit card to start a trial. At the end of the trial, you'll be asked to add payment to continue on the paid plan, or you'll automatically revert to the free tier.
Quotas:each plan has a monthly event limit. We accept events up to 2× your plan's limit (a "soft cap"); past 2×, we may stop accepting new events until the next billing period or until you upgrade. We notify you by email at 80% and 100%.
Refunds: we offer a 30-day money-back guarantee on paid plans, no questions asked. Email hello@gizmoanalytics.io and we'll process the refund within 5 business days.
Pricing changes:we may change plan pricing. We'll give existing customers at least 30 days' notice and grandfather them at the previous price for at least one full billing cycle.
Taxes: prices are in US dollars and exclusive of taxes. You are responsible for any sales tax, VAT, or other taxes that apply in your jurisdiction.
6. Your data
You retain ownership of any data you send to Gizmo, including all analytics events. We act as a processor for that data on your behalf. See our Privacy Policy for how we handle it.
You grant us a limited license to use your data solely to provide the Service: store it, query it, display it in your dashboard, return it via our APIs, and operate the infrastructure. We do not sell your data, train models on it, or share it with third parties beyond the processors named in our Privacy Policy.
If you delete your account, we delete your data within 30 days, except where we're legally required to retain it (e.g. invoicing records).
7. AI-assistant access (MCP)
Gizmo's MCP server lets your AI assistant (Claude, Cursor, etc.) read and write your workspace data using an admin API key you generate. You are responsible for what your AI assistant does with that key. Treat admin keys like passwords.
We rate-limit MCP calls per workspace. If your AI assistant exceeds those limits, calls will be rejected; this is not a failure of the Service.
8. Service availability
We aim for 99.9% uptime but make no guarantees. We may perform maintenance with reasonable notice. We're not liable for outages caused by upstream providers (Vercel, Neon, ClickHouse Cloud, Stripe, Resend) or by force majeure events outside our reasonable control.
9. Termination
You can cancel your account at any time. Cancellation takes effect at the end of your current billing period; we don't pro-rate refunds for unused time on monthly plans (yearly plan refund prorated).
We may suspend or terminate your account for material breach of these Terms, non-payment, or to comply with law. For non-payment we'll attempt to contact you before suspending. For severe abuse we may suspend immediately.
On termination, we provide a 30-day grace period to export your data if you ask. After that, data is deleted per our Privacy Policy retention rules.
10. Disclaimers
The Service is provided "as is" without warranties of any kind, express or implied. We don't warrant that the Service will be uninterrupted, error-free, or that analytics data will be 100% accurate. Web analytics are statistical; bots, ad-blockers, and edge-case browsers can all affect counts.
You are responsible for compliance with laws that apply toyou when using the Service — e.g. notifying visitors of analytics in your privacy policy if your jurisdiction requires it.
11. Limitation of liability
To the maximum extent permitted by law, Gizmo's total liability to you for any claim arising from or related to the Service is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim, or $100, whichever is greater.
We are not liable for indirect, incidental, consequential, special, or punitive damages, including lost profits, lost data, or business interruption, even if advised of the possibility of such damages.
12. Indemnification
You agree to defend, indemnify, and hold harmless Gizmo and its officers, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party right.
13. Governing law and dispute resolution
These Terms are governed by the laws of the Commonwealth of Pennsylvania, US, without regard to conflict-of-laws rules. Any dispute arising from these Terms or the Service will be resolved through binding arbitration in Pennsylvania, except that either party may seek injunctive relief in court for urgent intellectual-property matters.
You agree to bring claims only in your individual capacity and not as a class member.
14. Changes to these Terms
We may update these Terms over time. We'll post the new version here, update the date at the top, and email account holders for material changes. Continued use of the Service after a change constitutes acceptance. If you disagree with a material change, you may cancel your account before the effective date for a prorated refund of any prepaid amount.
15. Miscellaneous
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Gizmo regarding the Service. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce any right is not a waiver of that right. You may not assign these Terms without our written consent; we may assign them in connection with a merger or sale of assets.
